Welcome to Bekya Summer Hill. These Terms and Conditions ("Terms") govern your use of our website at bekya.com.au, our online ordering and reservation services, our Loyalty App, and your dining experience at our restaurant located at 32 Smith St, Summer Hill NSW 2130.

By accessing our website, placing an order, making a reservation, or using our Loyalty App, you agree to be bound by these Terms. Please read them carefully before proceeding. If you do not agree, please discontinue use of our services.

1.  About Us

2.  Use of Our Website

When using our website, you agree to:

3.  Online Ordering & Pick-Up

3.1  Placing an Order

  • Online orders are processed through our third-party platform (WowApps). By placing an order, you agree to their terms of service in addition to ours.
  • All menu items are subject to availability. We reserve the right to substitute or remove items without notice.
  • You must provide accurate contact and pick-up details when placing an order.
  • Orders are confirmed via email or SMS. If you do not receive confirmation, please contact us before your pick-up time.

3.2  Pricing & Payment

  • All prices are displayed in Australian Dollars (AUD) and are inclusive of GST.
  • Prices are subject to change without notice. The price at the time of order confirmation is final.
  • Payment is processed securely through our payment providers. We do not store your payment card details.
  • A surcharge may apply on public holidays as permitted under Australian law.

3.3  Cancellations & Refunds

  • Once an order is confirmed and preparation has begun, cancellations may not be possible. Please contact us as soon as possible if you need to cancel.
  • If you receive an incorrect or unsatisfactory order, please contact us within 24 hours at sam@bekya.com.au.
  • Refunds or replacements are offered at our discretion where a genuine error has occurred on our part.
  • We are not responsible for delays or issues caused by third-party delivery platforms.

4.  Table Reservations

  • Table reservations are managed through OpenTable. By making a reservation, you also agree to OpenTable's terms of service.
  • Please arrive within 15 minutes of your reservation time. We may release your table if you are late without prior notice.
  • For group bookings of 8 or more, please contact us directly on 0485 012 877.
  • We reserve the right to refuse service or cancel a reservation at our discretion.
  • Private event bookings are subject to a separate agreement and deposit requirements.

5.  Loyalty Rewards App

  • Our Loyalty App is available on the Google Play Store. Use of the app is subject to these Terms and our Privacy Policy.
  • Members earn points on eligible purchases. Points have no cash value and cannot be transferred or sold.
  • A 5% discount applies to orders placed through the Loyalty App by registered members.
  • We reserve the right to modify, suspend, or terminate the loyalty programme at any time with reasonable notice.
  • Accounts found to be abusing the rewards system may be suspended or permanently banned.
  • Points may expire after a period of inactivity as communicated in the app.

6.  Allergens & Dietary Requirements

While we take care to accommodate dietary requirements, our kitchen handles a wide range of allergens including nuts, gluten, dairy, eggs, sesame, and shellfish. We cannot guarantee a completely allergen-free environment.

Guests with severe allergies or dietary requirements must inform our staff before ordering. We accept no liability for allergic reactions or dietary concerns where this information was not disclosed at the time of ordering.

7.  Intellectual Property

All content on our website — including text, images, logos, graphics, videos, and menu designs — is the intellectual property of Bekya Summer Hill or its licensors and is protected under Australian and international copyright law.

You may not reproduce, distribute, modify, or create derivative works from any of our content without our prior written consent. You may share links to our website for personal, non-commercial purposes.

8.  User-Generated Content & Reviews

  • By submitting a review, photo, or comment on our website or social media pages, you grant us a non-exclusive, royalty-free licence to use, display, and share that content for marketing purposes.
  • You confirm that any content you submit is your own and does not infringe the rights of any third party.
  • We reserve the right to remove content that is offensive, misleading, or in breach of these Terms.
  • We are not responsible for content posted by third parties on external review platforms.

9.  Limitation of Liability

To the fullest extent permitted by Australian law, Bekya Summer Hill is not liable for any indirect, incidental, consequential, or special damages arising from your use of our services, website, or Loyalty App.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law, which cannot be lawfully excluded or limited.

10.  Third-Party Services

Our services integrate with third-party platforms including OpenTable, WowApps, Google, and the Australian Good Food Guide. We are not responsible for the availability, accuracy, or conduct of these third-party services. Your use of those platforms is governed by their respective terms and conditions.

11.  Conduct on Our Premises

  • Guests are expected to behave in a respectful manner towards staff and other diners at all times.
  • We reserve the right to refuse entry or service to any person at our discretion.
  • Smoking and vaping are not permitted inside the restaurant or in areas that may affect other guests.
  • We accept no liability for loss or damage to personal belongings on our premises.
  • CCTV may be in operation at our venue for the safety of staff and guests.

12.  Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

We may update these Terms from time to time. The revised Terms will be posted on our website with an updated "Last Updated" date. Continued use of our services after any changes constitutes your acceptance of the new Terms.
